Fix/breaking compiler test 2710

Fixes #2710

With the help of the team at swat.engineering the issue was reduced to a manageable reproduction case.

Further analysis showed that operations on the memory file system can be so fast that an imprecise comparison of modification dates was exposed. This has been fixed here.
