this PR replaces #1021 introduced with this [commit](https://github.com/json-everything/json-everything/pull/970/files#diff-a59cd230078398e57d6a4c2c6b766c24641b22ccdf3105a7e8bca23da7380e6e) in JsonPatch: empty arrays gets replaced instead of elements being added I also updated the test assertions to use fluent-assertions jsonnode support
