The error in that run is:

This happens inside claude-code-action@v1 (SHA bee87b3) — the action tries to run claude to add the marketplace plugin, but the CLI binary isn't available in $PATH yet at that point. It's a race/ordering issue in the action's setup sequence, not anything in this repo's configuration.

I checked the other recent tend-review failures and none of them have this same error — the other failures are from different causes. So this appears to be intermittent. The run that triggered this issue was for #5761 (the mypy bump), and a subsequent tend-review run on that same PR at 01:29 succeeded fine with the same action versions.

This is an upstream issue in anthropics/claude-code-action — the marketplace installation step occasionally fires before the claude binary is on $PATH. Since it's intermittent and recovers on retry, not much to do on this repo's side. Worth reporting upstream if it keeps happening frequently.

ok, though it seems unlikely to be stochastic whether or not claude is installed? or there's a race condition somewhere? do much more research please. create an issue on tend if you can't figure it out

You're right that it's not stochastic — the root cause is deterministic. Here's what happened:

The curl download got rate-limited (429), but the action thought installation succeeded.

From the failed run logs:

Why the action doesn't detect the failure: claude-code-action installs via curl -fsSL https://claude.ai/install.sh | bash -s -- <version>. In a shell pipe, the exit code is from the last command (bash), not curl. When curl gets a 429, it exits non-zero, but bash -s receives empty input, does nothing, and exits 0. The pipeline reports success. The action has retry logic (3 attempts), but it never triggers because the first attempt appears to succeed.

This has happened before — anthropics/claude-code-action#1091 reported the same pattern with a 403 instead of 429. That issue was closed but the underlying pipeline bug wasn't fixed.

The fix is straightforward — the install command needs set -o pipefail so curl's failure propagates:
