Terms of Service — SecureChat

1. Acceptance of Terms

By installing, copying, or using SecureChat (the "Application"), you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Application.

1.1. Age Requirement

SecureChat is not intended for use by anyone under the age of 16 (or the minimum digital age of consent in your jurisdiction, as defined by GDPR Article 8 or equivalent local laws). By using the Application, you represent that you are at least 16 years old. If you are under the applicable age, you must not use this Application.

2. Description of Service

SecureChat is an end-to-end encrypted (E2E) messaging application using the PQXDH protocol (X25519 + ML-KEM-1024) and Double Ratchet. The Application is provided free of charge and as-is.

3. Disclaimer of Warranties

The Application is provided "as is", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, non-infringement, availability, or absolute security.

The developer does not warrant that the Application will be error-free, uninterrupted, or that defects will be corrected.

3.1. Security Disclaimer

The cryptographic implementation in this Application has NOT been independently audited by a third-party security firm. While the developer has made every reasonable effort to implement industry-standard cryptographic protocols (PQXDH, Double Ratchet, AES-256-GCM, Ed25519), no guarantee of absolute security is made or implied.

This Application is developed as a personal and educational project by an independent developer. It is not a commercial product, not backed by a security team, and should not be relied upon as your sole means of secure communication in life-threatening or legally sensitive situations.

Users requiring certified security guarantees should use professionally audited and commercially supported solutions.

4. Limitation of Liability

In no event shall the developer be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to:

  • Loss of data or messages
  • Interception of communications despite encryption
  • Damages resulting from the use or inability to use the Application
  • Content exchanged between users through the Application
  • Actions of third parties accessing the Application

5. User Responsibility

You are solely responsible for:

  • The content you send, receive, or share through the Application
  • Safeguarding your recovery phrase (BIP-39 / 24 words)
  • Compliance with applicable laws in your jurisdiction
  • The security of your device and credentials

SecureChat does not store any private keys on its servers. Loss of your recovery phrase results in permanent and irreversible loss of access to your account.

6. Prohibited Content

Use of the Application for illegal purposes is strictly prohibited, including but not limited to:

  • Distribution of child sexual abuse material (CSAM)
  • Terrorism or incitement to violence
  • Harassment or threats
  • Fraud or scams
  • Any activity violating applicable laws

7. Infrastructure and Relay

The developer reserves the right to:

  • Suspend, modify, or terminate the relay service at any time, without prior notice or obligation to justify
  • Modify the technical infrastructure without prior notification
  • Limit or block access in case of abuse

The relay is an optional transport component. The Application can operate with alternative relays.

8. Data and Privacy

  • No message is readable by the developer — E2E encryption ensures that only participants can read messages
  • No personal data is collected for commercial purposes
  • Transport metadata (IP addresses) is routed through Tor and is not logged

9. Open Source Software

SecureChat is distributed under the GNU General Public License v3.0 (GPL-3.0). The source code is available on GitHub. The full GPL-3.0 license can be found in the LICENSE file.

10. Cryptography Export Notice

This Application contains cryptographic software. The export, re-export, or transfer of cryptographic software may be restricted by the laws of your country or jurisdiction, including but not limited to the Wassenaar Arrangement, EU Dual-Use Regulation (EC 428/2009), and the U.S. Export Administration Regulations (EAR).

You are solely responsible for verifying that your download, use, and/or distribution of this Application complies with all applicable export control laws and regulations in your jurisdiction. The developer assumes no liability for violations of export or import laws by users.

11. Indemnification

You agree to indemnify, defend, and hold harmless the developer from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

  • Your use or misuse of the Application
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Any content you transmit through the Application
  • Any third-party claims related to your use of the Application

12. Changes to Terms

The developer reserves the right to modify these Terms at any time. Changes will be published in this file and on the website. Continued use of the Application after modification constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by French law. Any dispute shall be submitted to the competent courts in France.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall remain in full force and effect.
